1.0 General Information

O‘Neil & Associates, Inc. (“ONEIL” or “we”) is committed to protecting your privacy, including that of existing and potential clients, applicants, business partners, contributors, and visitors to oneil.com websites. This Privacy Policy addresses how ONEIL collects, retains, shares, or otherwise uses your personal data, and it describes the privacy practices for all oneil.com websites. For purposes of this Privacy Policy, the term “personal data” means any information which, either alone or when combined with other information, can be used to identify, distinguish, or trace an individual’s identity and is subject to any applicable data protection law, statute, or regulation. The personal data you provide will be kept confidential and used only for such purposes that are described or evident at the point of collection. 2.0 Why we collect and process data

ONEIL collects and processes personal data in a fair, lawful, and transparent manner for the following reasons:

  • Where it is necessary for the performance of our agreement, or to enter into an agreement, with you to provide or receive products and/or services.
  • Where it is necessary for compliance with legal or regulatory obligations that we are subject to.

3.0 What data we collect and process

3.1 Website and Online Services: Personal Contact Information

ONEIL websites offer some services that require you to provide some personal data to use them. We collect the minimum personal data that enable us to provide these services. All of these services are optional; if you do not wish to provide personal data, you may simply decline to take advantage of that service.

We will ask you to provide personal data including, but not limited to, your name, professional title, organization/company, e-mail, and phone number in the following situations:

  • Downloading brochures and similar media.
  • Requesting return contact from ONEIL.
  • Inquiring about an employment position.
  • Subscribing to our blog.
  • Commenting on posts.
  • Resetting an ONEIL network account.

3.2 Web Servers

When visitors access our website, servers automatically receive certain basic information like the visitor’s IP address, web browser version, operating system, etc. This technical information does not by itself identify a specific individual. We use this data to better manage and improve the website presentation and organization.

3.3 Tracking Data and Cookies

ONEIL uses third-party providers, such as Google Analytics, to monitor our websites for analytical, usability, and marketing purposes. Our analytics providers use cookies, which are text files placed on your computer to collect information anonymously and allow us to look at trends without identifying individual users. ONEIL uses cookies to store form data, preferences, and similar information to give users the best possible experience. We may also use cookies to serve advertisements on other sites.

Please note that if you disable cookies, you may not get the best experience or full functionality of a website.

Pages on oneil.com sites may have embedded content (e.g., videos, images, videos, etc.) from other sites. Embedded content works the same way as if the visitor has visited the other website.

3.4 Customers, Vendors, and Suppliers

ONEIL collects and processes routine business contact and similar information on our customers, vendors, and suppliers. Generally, this information consists of the following: names, contact details (e.g., e-mail addresses, postal addresses, telephone numbers), professional titles and other employment related information, bank account details and financial information (including credit/income history), transaction history, communications, and criminal records. We process this information to facilitate routine and common business practices and for the other purposes described above, including facilitating sales and product order management; promotions and marketing; warranty management; credit collection; enforcement of, and compliance with, legal requirements; and defending our interests.

4.0 Third-Party Websites

ONEIL’s website may contain links to other third-party websites. The operators of those third-party sites may collect information from you which will be used by them in accordance with their own privacy policies. We have no liability or responsibility for those websites, their policies, or their collection or other processing of your personal data. The practices of those third parties with respect to information collected through their websites is governed by their own privacy policies and we encourage you to learn about the privacy policies of those third parties.

5.0 Your Rights

5.1 European Union Data Protection Laws and Rights

If you are located in the European Economic Area, ONEIL acknowledges you have certain rights regarding your personal data:

  • Right to be informed of our data practices.
  • Right of access to review what data we have about you, if any, in a structured, commonly used, and machine-readable format.
  • Right to rectification of any data we have about you.
  • Right to deletion of any data we have about you.
  • Right to restrict processing of data.
  • Right of data portability.
  • Right to object about our use of your data and lodge a complaint to a supervisory authority.

ONEIL reserves the right to refuse a request or charge a reasonable fee for manifestly unfounded or excessive requests considering the administrative costs of verifying your identity, providing the information, communication, and taking the requested action. You have the right to lodge a complaint with your competent data protection authority. If you wish to exercise any of these rights, please contact us in accordance with the instructions provided below in the “Contact Info” section. We may need to collect and process information about you solely for the purpose of responding and satisfying any data right request you may have.

5.2 California Privacy Rights

Pursuant to California law, California residents who provide personal data to obtain products or services for personal, family, or household use are entitled to request and obtain, once a calendar year, information about the personal data we shared, if any, with other businesses for marketing uses. ONEIL does not, at any time, share your personal data with a third party with whom we know, or have reason to believe, uses the personal data to undertake independent direct marketing.

5.3 Do Not Track Responses

Some browsers have a “Do Not Track” feature, which permits you to inform websites you visit that you do not want them to track your online activity. These features are not yet uniform across browsers. Therefore, our website is not able to respond to “Do Not Track” browser requests.

5.4 Information about Children

We do not knowingly collect or solicit personal data from anyone under the age of sixteen (16) years old. If you are under sixteen (16), please do not attempt to register for any services on our website or otherwise provide us with your personal data. If you believe we may have erroneously collected information from or about a child under age sixteen (16), please contact us in accordance with the instructions provided below in the “Contact Info” section.

5.5 Marketing Communications

You can exercise your right to prevent marketing communications to you by not checking certain boxes on the forms we use to collect your personal data, or by utilizing opt-out mechanisms in emails we send to you. You can also exercise the right to discontinue marketing communications to you, or to have your personal data removed from our customer relationship management (CRM) databases at any time by contacting us. In such cases, we will retain minimum personal data to note that you opted out in order to avoid contacting you again.

6.0 Security

ONEIL employs layers of industry-leading security technology and coding techniques to protect information. When you submit personal data via the website, your information is protected both online and offline.

ONEIL maintains an ISO/IEC 27001:2013 compliant Information Security Management System and a Privacy and Data Protection Program.

Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to our website. Any electronic transmission of personal data (e.g., over the internet) is at your own risk, and ONEIL is not responsible for circumvention of any privacy settings or security measures contained on our website.

7.0 Sharing Personal Data and Third-Party Disclosures

ONEIL does not rent or sell your personal data to anyone. However, we may share and disclose information (including personal data) about you in the following limited circumstances:

We may share your personal data with third-party vendors, consultants, and other service providers who we employ to perform tasks on our behalf. These companies include (for example) our payment processing providers, website analytics companies (e.g., Google Analytics), outside counsel and tax consultants, CRM service providers (e.g., Salesforce), e-mail service providers, and others.

We may share your personal data in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ONEIL’s practice or assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by ONEIL or our website users is among the assets transferred.

We may share your personal data to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce or apply our terms of use and other agreements, including for billing and collection purposes, and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of ONEIL, our customers, or others.

We may share your personal data for any other purpose for which we have your consent or to fulfill any other purpose for which you provide the information to us.

8.0 Personal Data Stored in the United States

The information (including personal data) ONEIL collects about you is stored in the United States and will be processed and retained in accordance with this Privacy Policy. If you are located outside of the United States, please be aware information you submit will be transferred to United States, and that the United States law and this Privacy Policy may not provide the same level of protections as the requirements in your country. By continuing to provide us such information you hereby consent to this transfer.

9.0 Data Retention

The following describes our retention guidelines:

  • Comments: Content and associated metadata are retained indefinitely so we can moderate any future follow-ups about that comment.
  • Contact Data: Contact data is kept for a time of ONEIL’s discretion unless you request otherwise so ONEIL can reach you using your preferred method for the purpose(s) for which you consented.
  • Profile Data: User profile data is kept for a time of ONEIL’s discretion unless you request otherwise.

10.0 Automated data decision making and/or profiling

ONEIL does not make use of automated data decision making and/or profiling with personal data collected through oneil.com sites.
